Section 86 of the Code of Civil Procedure, Indians working in foreign diplomatic missions here are exempt from requesting authorization from the Center before suing their employers in an industrial tribunal.

In order to give legal force to a convention that India had ratified at the United Nations Conference on Diplomatic Intercourse and Immunities, which took place in Vienna on April 14, 1961, Parliament passed the Diplomatic Relations (Vienna Convention) Act, 1972.

Only foreign nationals serving in a diplomatic mission would be exempt from the receiving State's social security laws, according to Article 33 of the Convention.

As a result, citizens of the receiving State are not covered by the exemption granted by the article.

Before laying off a permanent employee, an employer must provide compensation equal to 15 days' average salary for each completed year of service, according to Section 25F of the Industrial Disputes (ID) Act, 1947.

Lottery Taxation Authority Regulations

According to the Supreme Court, only state governments, not the federal government, are able to levy taxes on lotteries.

According to the Constitution's Seventh Schedule, Entry 62 of the State List defines lottery as "betting and gambling."

This was a clear indication that the only legislatures with the authority to tax them are the state legislatures.

Not all states operate lotteries the same way; some have outright prohibited them, while others only permit and regulate them.

In order to impose a service tax on operations connected to lotteries, the federal government amended the Finance Act in 2010, 2012, 2015, and 2016.

The Center was alleging that selling, marketing, promoting, and distributing lotteries constituted a taxable "service."

 

Reservations for higher judicial appointments

The discussion regarding reservations in higher judicial appointments was reignited when DMK MP P. Wilson filed a private member's bill in the Rajya Sabha.

It is requesting that SC/ST and OBC judges be given preference when they are appointed to the Supreme Court and lower courts.

When choosing a Chief Justice or judge for any High Court, it also requested that the Indian government confer with the corresponding State governments.

Approximately half of the judges should be female, according to the Committee's recommendation in the 84th Report on Demand for Grants.
