Senate Bill Seeks Repayment of IEEPA Tariff Revenues

Democratic lawmakers in the United States Senate have introduced legislation requiring the refund of tariff revenues invalidated by the US Supreme Court. The proposal follows the Court’s decision striking down broad tariffs imposed under the International Emergency Economic Powers Act (IEEPA) during President Donald Trump’s administration.

Legislative Framework for Refunds

Backed by 22 Democratic senators, the bill directs Customs and Border Protection (CBP) to return duties collected under IEEPA that were later ruled unlawful. Importers affected by the tariffs would receive repayments within 180 days, accompanied by accrued interest.

Although the Supreme Court nullified the tariffs, it did not mandate automatic refunds, instead referring the issue to a lower trade court. The Senate proposal seeks to remove ambiguity by compelling refunds even for duties already finalised by CBP.

Emphasis on Small Business Relief

The legislation prioritises small businesses in the refund process. Sponsors argue that smaller firms and manufacturers absorbed significant cost pressures from higher import duties and supply chain disruptions.
