Odisha Announces Statewide Ban on Gutkha and Tobacco Products
The government of Odisha has announced a comprehensive ban on gutkha, pan masala, and all tobacco- and nicotine-containing products, marking one of the strictest public health interventions in the state’s history. The decision aims to curb rising health risks linked to tobacco consumption and align state enforcement with national and judicial directives.
Scope of the Prohibition
The ban, issued by the Health and Family Welfare Department, prohibits the manufacture, processing, packaging, storage, transportation, distribution, and sale of gutkha, pan masala, and all tobacco or nicotine products. It applies to both packaged and unpackaged forms, including items sold separately but intended to be mixed for consumption. By covering every stage of the supply chain, the notification closes loopholes that previously allowed indirect sale and misuse.
Alignment with Supreme Court Directions
Odisha had earlier restricted the sale of tobacco products in 2013, but enforcement gaps remained. The updated notification removes ambiguities and ensures full compliance with Supreme Court directions mandating a nationwide prohibition on gutkha and pan masala. State Health Secretary Aswathy S stated that the revised rules are designed to ensure uniform enforcement and prevent circumvention under alternative product names or formulations.
Ban on All Chewable Variants
The prohibition extends to all chewable food products containing tobacco or nicotine, whether flavoured or unflavoured, scented, or mixed with additives. Products marketed under different brand names or compositions also fall under the ban, ensuring that no variant escapes regulatory oversight.
Revised Tax Regime from February 2026
In parallel with the ban, higher taxation on tobacco-related products will come into force from February 1, 2026. Pan masala, cigarettes, and similar products will attract 40% GST, while beedis will be taxed at 18% GST. Additional levies, including a Health and National Security Cess and higher excise duties, will also be imposed. New rules governing packing machines for chewing tobacco, jarda scented tobacco, and gutkha will take effect on the same date, while the existing GST compensation cess will be discontinued.
