Bihar Civil Nyayalay Bill 2026 Modernises Court Framework

The Bihar Legislative Assembly has unanimously passed the Bihar Civil Nyayalay (Court) Bill, 2026, repealing the colonial-era Bengal, Agra and Assam Civil Courts Act, 1887. The legislation marks a structural update of the state’s subordinate civil court system, replacing a statute that had governed court administration for more than a century.


Reforming the Civil Courts Framework

The 1887 Act, enacted under British rule, provided the legal architecture for civil courts across multiple provinces, including Bihar. Over time, evolving judicial needs and administrative practices rendered several provisions outdated.

The Bihar Civil Nyayalay (Court) Bill, 2026 seeks to modernise institutional arrangements, clarify jurisdictional structures and streamline court administration. The unanimous passage indicates broad political consensus on strengthening judicial efficiency and aligning legal mechanisms with contemporary governance standards.


Companion Amendment Bills

During the same sitting, the Assembly approved three amendment Bills via voice vote:

  • Bihar Technical Services Commission (Amendment) Bill, 2026

  • Bihar Staff Selection Commission (Amendment) Bill, 2026

  • Bihar Municipality (Amendment) Bill, 2026

The revised recruitment framework assigns responsibility for second- and third-grade posts in state boards and corporations to the Technical Services Commission. Fourth-grade appointments will be managed by the Staff Selection Commission, aiming to enhance transparency and institutional accountability.


Changes in Municipal Governance

The Bihar Municipality (Amendment) Bill introduces procedural changes in the formation of empowered standing committees within municipal bodies. Committee members will now be elected through secret ballot rather than being nominated by the mayor.

The government further assured that committee meetings would not coincide with legislative sessions, recognising the ex officio role of MLAs and MLCs in municipal governance structures.


Legislative Efficiency

All four Bills were introduced and cleared within a brief sitting, highlighting procedural efficiency in legislative functioning.
