Centre Approves Strength of Supreme Court Judge Strength to 37.

Article 124 states:

  • The Supreme Court will be comprised of the Chief Justice of India.
  • The law can be used by parliament to determine how many other judges they want.

This will give Parliament the authority to add or subtract the number of judges when necessary.


The history of Supreme Court Strength.

There has been a gradual increase in the number of judges in the Supreme Court.

Timeline of changes:

  • 1950: 7 judges in addition to CJI.
  • 1956: Strength set to 10 judges.
  • 1960: Increased to 13
  • 1977: Increased to 17
  • 1986: Increased to 25
  • 2008: Increased to 30
  • 2019: Increased to 33
  • 2026 proposal: Increase to 37

This indicates the way in which the judiciary has been growing along with the growth of the country.


Advantages of More Judges.

The four new judges may introduce numerous changes.

1. Reduction in the time required to dispose of cases.
The number of benches that can hear cases at a time can be increased.

2. Better Case Management
Complex cases get to be dealt with more effectively.

3. Less Burden on Existing Judges.
Judges will not have to experience the pressure of work.

4. Access to Justice is better.
The judgment by citizens may be quicker.


Money and Financing.

The money to be used in the extra judges will be provided by the Consolidated Fund of India.

This fund is the principal financial account of Government of India.

It includes:

  • Government revenues
  • Loans raised by the government
  • Loan repayments

Expenses related to:

  • Salaries
  • Infrastructure
  • Staff support
  • Court facilities

will be met out of this fund.
